The management and shipment of the products are carried out by Tipple Operations LTD, a company registered in Ireland, with its address at 25 Herbert Place, Dublin, Dublin 2, Ireland (D02 AY86).

In accordance with applicable legislation, the user is hereby informed that the personal data provided will be processed solely for the purpose of properly managing their purchase and maintaining and performing the commercial relationship between the user and DUG.

Your personal data will be processed for the period strictly necessary to fulfil the purpose for which it was collected and for as long as you do not withdraw your consent or exercise your rights to object to or request the deletion of your data, without prejudice to the retention of such data for as long as DUG remains subject to applicable legal obligations.

For the proper provision of its services, DUG may need to disclose certain personal data to third-party service providers, exclusively for the proper operation of the company. In particular, DUG informs you that it will transfer your data to Tipple Operations LTD so that the company may manage, on behalf of DUG, product orders, shipments and any returns or exchanges.

You are hereby informed that you have the right to access, rectify, erase and object to the processing of your personal data, as well as the rights to restrict processing and data portability. You may also withdraw your consent at any time. These rights may be exercised by verifying your identity and contacting DUG by email at: info@duggroup.com.

DUG undertakes to respond to all requests submitted to it. DUG will respond within one month of receiving the request. However, depending on the complexity of the request or the number of requests received, this period may be extended up to three months. Where applicable, you will be informed of such an extension within one month of receipt of the request.

The data subject undertakes to keep the information provided to DUG properly updated. Where the data provided by you is false, incomplete, outdated or inaccurate, you will be responsible for any direct or indirect, material or non-material damage that may consequently be caused to a third party or to DUG.

3. Purchase Terms and Conditions

These Purchase Terms and Conditions apply to all sales of products offered through this website, hereinafter referred to as the “Products”. Together with the offer, price and description of the Products displayed on the website and, where applicable, any specific conditions set out in this document, these terms will govern the legal relationship between DUG Portugal, Unipessoal SA, hereinafter referred to as “DUG”, and the CUSTOMER.

These Purchase Terms and Conditions will remain valid for as long as they are published on the website and will apply to purchases of Products made while these terms are available.

Acceptance of these Purchase Terms and Conditions by the CUSTOMER is an essential requirement for entering into any contractual relationship between the CUSTOMER and DUG. We can only accept orders placed by persons of legal age.

Identification of the Parties

On the one hand, DUG, the operator of the website, with its registered office at Rua do Esmeraldo, 47, Floor 3, 9000-051 Funchal, Portugal, and tax identification number PT511179766.

On the other hand, the CUSTOMER, who must be of legal age and whose details are those entered by the CUSTOMER in the relevant forms. All information included in such forms has been entered directly by the CUSTOMER, and therefore the CUSTOMER is solely and exclusively responsible for its authenticity.

Purpose of the Agreement

By accepting these Purchase Terms and Conditions, DUG undertakes to make the Products purchased through the Website available to the CUSTOMER, and the CUSTOMER undertakes to pay the price indicated at the time of purchase.

Registration Process

To purchase the Products offered by DUG through the Website, the user may at some point be offered the option to register, or registration may be required for the proper management of the order.

The user may register at any time before beginning the purchase process. During the registration process, the user is solely responsible for the quality of the information entered in the forms and agrees to provide truthful, accurate and complete information regarding their identity, as requested in the registration, purchase and verification forms. The user must also update all registration information so that it remains truthful, accurate and complete.

The user may modify and/or update their information at any time by accessing their User profile on the website. However, we recommend always checking that any information entered or modified is correct, particularly the email address and the delivery address for orders, in order to avoid future issues.

Once the user has entered their information and clicked the registration button, we will send a confirmation email to authenticate the information provided during registration. The sending and receipt of this email are normally automatic and will, in any case, take place as soon as possible.

Where the user has not received an order confirmation by email, this may be due to a temporary communication failure or an error in the email address provided. In either case, the user must contact us as soon as possible at: info@duggroup.com.

Where the user provides false, inaccurate or incomplete information, or where DUG has sufficient grounds to suspect that such information is false, inaccurate or incomplete, DUG will have the right to deny the user current or future access to and use of the Website or any of its services.

Products

All information concerning the Products offered by DUG, including but not limited to prices, characteristics, descriptions, size and contents, is made available to the user on the Website and will be displayed on screen in each case.

Purchase System

To purchase Products offered through the Website, users may be required to register. In all cases, users must accept the Privacy Policy and these Purchase Terms and Conditions and confirm that they are of legal age.

Personal data must be provided accurately in order to avoid confusion or issues with the provision of the Service and the delivery of purchased Products. Products intended for purchase must be selected and added to the shopping cart by clicking the relevant icon.

After selecting the desired Products, the user must complete the relevant purchase form displayed on screen. The form will be accompanied by a summary identifying the selected Products, their total price, applicable taxes and, where applicable, shipping costs.

Verification of this information is solely and exclusively the responsibility of the user. DUG will not be liable to the user for errors or inaccuracies in an order where DUG has supplied the Products listed in the order confirmation.

Where the user provides false, inaccurate or incomplete information, or where DUG has sufficient grounds to suspect that such information is false, inaccurate or incomplete, DUG reserves the right to cancel the CUSTOMER’s purchase.

In such a case, DUG will notify the user and refund the amounts paid, less any costs generated by the transaction, using the same payment method used for the purchase and within fourteen (14) days following such notification.

Once the purchase form has been completed, the user must accept these Terms and Conditions and confirm that they are of legal age. Once accepted, the user will be redirected to an online payment platform, where the purchase may be completed using any of the accepted payment methods.

Once the transaction has been confirmed, the user will receive an email containing the order information.

Prices

The characteristics and prices of the Products are displayed on screen in euros and include applicable taxes. The prices displayed will be those valid at the relevant time, except in the event of a typographical error.

Such taxes will be itemised on the invoice. Prices displayed on the Website supersede all previously published prices and are valid from the moment of publication.

DUG undertakes to make every reasonable effort to maintain these prices but reserves the right to modify them without prior notice. Price changes will not affect orders that have already been placed.

Payment Methods and Security

DUG accepts orders at any time, 24 hours a day, every day of the week. DUG offers different payment methods so that users may choose the option that best suits their needs.

Credit card: The user may pay for purchases using the credit cards indicated as accepted. The purchase will be processed through a payment gateway in order to ensure the security and confidentiality of the user’s data.

The user must confirm that the credit card being used belongs to them or that the cardholder has authorised its use. Credit cardholders are subject to validation checks and authorisation by the card issuer.

Where the card issuer refuses to authorise payment to DUG, DUG will not be liable for any resulting delay in delivery.

DUG reserves the right to cancel an order where it considers that the information provided by the user cannot be verified or where it considers that the Product has been purchased by the user for resale.

DUG will not be liable for delays in the delivery of orders resulting from a lack of authorisation by the payment system.

Shipping, Exchanges and Returns

Product shipments are carried out by Tipple Operations LTD, a company registered in Ireland, with its address at 25 Herbert Place, Dublin, Dublin 2, Ireland (D02 AY86), and registration number 695207.

Tipple Operations acts as the importer, logistics operator and sales operator for DUG’s Products.

After-Sales Service and Contact

Our Customer Service department provides an after-sales service to help resolve any issues relating to our Products or deliveries, offering customers a prompt and efficient response.

Intellectual and Industrial Property

DUG guarantees to the user that it owns the intellectual and industrial property rights relating to the Products sold and/or, where applicable, that it holds the necessary authorisation to market such Products through its Website.

The user acknowledges and accepts that the Products, as well as their contents, packaging, materials and other elements, are protected by intellectual and industrial property rights owned by DUG and/or third parties.

The purchase of Products and browsing of DUG’s Website will under no circumstances be understood as a waiver, transfer, licence or total or partial assignment to the user of any intellectual or industrial property rights owned by DUG or, where applicable, by the relevant third party.

The user may not alter, exploit, reproduce, distribute or publicly communicate the Website, its contents or the Products purchased through it without the prior and express authorisation specifically granted for that purpose by DUG or, where applicable, by the relevant third party.

Amendments to the Terms and Conditions

DUG reserves the right to amend this agreement whenever it considers it appropriate or for the purpose of adapting the text to legislative or technological changes or to changes in its contractual relationships with third parties.

The user will be duly informed of such amendments.

Partial Invalidity

Where any provision of these Purchase Terms and Conditions is unlawful and therefore invalid, this will not affect the remaining lawful provisions.

The parties undertake to renegotiate any provisions of the contractual terms that are declared invalid and to incorporate the revised provisions into the remainder of the contractual terms.

Applicable Law and Dispute Resolution

These Purchase Terms and Conditions will be governed by and interpreted in accordance with Spanish law.

The Parties agree to attempt to resolve any disagreement or dispute through out-of-court procedures. Only where this is not possible will the Parties submit the matter to the courts and tribunals having jurisdiction under applicable law.

Where the User qualifies as a consumer, the courts and tribunals of the User’s place of residence will have jurisdiction over any dispute.

In such a case, we inform you that, as a consumer, you have the right to request the out-of-court resolution of consumer disputes through the online dispute resolution platform developed by the European Commission, available at: http://ec.europa.eu/consumers/odr/
